Terms of Service
The short version: 30 days free with no card. After that it's $60 a month (AUD, plus GST) for any team size. Cancel any time from the Billing page and you keep access until the end of the month you've paid for. Muster helps you roster and track hours, but you are still responsible for paying your staff correctly.
These terms are an agreement between you and Muster (ABN 51 392 402 605, Queensland, Australia — "we", "us"). They apply when you create a Muster account or use the Muster website or app. If you sign up on behalf of a business, you agree to them for that business and confirm you're allowed to do so.
1. Who the terms apply to
Business owners and admins ("you") subscribe to Muster and manage a business account. Staff members join a business account by invitation. Staff use Muster for free; the business they work for is the customer. Sections 2 to 4 apply only to the business.
2. Free trial
- New businesses get a 30-day free trial with every feature included.
- No card is needed to start, so nothing is charged unless you choose to subscribe.
- If you don't subscribe by the end of the trial, the business account is paused. Your data is kept, and you can subscribe later to pick up where you left off.
- If you subscribe during the trial, your first charge happens when the trial would have ended (unless fewer than two days remain, in which case billing starts straight away).
3. Price and billing
- Muster costs $60 per month, in Australian dollars, plus GST, for any number of staff.
- The subscription renews automatically each month on the same date until you cancel.
- Payments are processed by Stripe. We never see or store your full card number.
- If a payment fails, your account keeps working for 7 days while you update your card. After that, access may be paused until payment goes through.
- We may change the price in the future. If we do, we'll email you at least 30 days before the new price applies to you, so you can cancel first if you don't want to continue.
- Any special pricing agreed with you in writing (for example, a founding-member rate) applies on the terms agreed at the time.
4. Cancelling and refunds
- You can cancel at any time from the Billing page in Muster, or by emailing hello@muster-system.com. There are no contracts or cancellation fees.
- When you cancel, you keep access until the end of the month you've already paid for and you won't be charged again. You can undo the cancellation any time before then.
- We don't give partial refunds for the unused part of a month, because you keep full access until it ends.
- If you were charged by mistake — for example, charged twice, or charged after you cancelled — tell us and we will refund it.
- Nothing in these terms limits your rights under the Australian Consumer Law. If Muster has a major failure, you're entitled to a refund or other remedy the law provides.
5. Your responsibilities
- Keep your login details safe and tell us if you think someone else has used your account.
- Only add people to your business account that you're allowed to, and make sure the information you enter about them — including pay rates, award classifications and ages — is accurate.
- If you add staff who are under 18, you're responsible for meeting your obligations to them and, where needed, to their parent or guardian.
- Tell your staff that you use Muster to manage their rosters and hours, and point them to our Privacy Policy.
- Don't use Muster for anything unlawful, try to access another business's data, disrupt the service, or resell it without our written permission.
6. Awards, pay and payroll
Muster helps you check pay rates, but it is not payroll software and it does not give legal or employment advice.
- Muster checks base pay rates against the Fair Work minimum for the award and classification you choose, and shows that award's penalty rates. It does not yet apply every award rule. For example, evening penalties, minimum shift lengths, junior rates and allowances still need checking against your award.
- Award data comes from the Fair Work Commission and can change. We aim to keep it up to date but can't guarantee it is always current or complete.
- Muster doesn't run payroll, pay superannuation or lodge Single Touch Payroll. It produces hours for your payroll process or accountant to use.
- You remain responsible for paying your staff correctly and meeting your obligations under the Fair Work Act and your award. If you're unsure, check with the Fair Work Ombudsman (fairwork.gov.au) or an adviser.
7. Your data
- Your business's data belongs to your business. We use it only to provide Muster, as our Privacy Policy describes.
- You can export hours as a CSV file at any time while your account is active.
- After you cancel, we keep your data so you can come back, and so time and wage records are available for the period the law generally requires. You can ask us to delete it sooner, subject to those record-keeping obligations.
8. The service
- We work hard to keep Muster running and your data safe, but we can't promise it will always be available or free of errors. We may need to take it offline briefly for maintenance.
- We improve Muster over time and may change features. If we remove something important you rely on, we'll give you reasonable notice.
- The Muster software, name and design belong to us. Your subscription lets you use Muster; it doesn't transfer ownership of it.
9. Suspending or ending an account
We may suspend or close an account if it's used unlawfully, puts other customers or the service at risk, or seriously breaches these terms. Where it's reasonable to, we'll contact you first and give you a chance to fix the problem. If we close your account for a reason other than your breach, we'll refund any time you've paid for but not received.
If we ever stop offering Muster, we'll give at least 60 days' notice so you can export your data.
10. Liability
Some rights under the Australian Consumer Law can't be excluded, and nothing in these terms tries to. Where the law allows us to limit our liability for a failure to meet a consumer guarantee, our liability is limited to supplying the service again or paying the cost of having it supplied again.
Otherwise, and to the extent the law allows:
- we are not liable for indirect or consequential loss, such as lost profits or business interruption;
- we are not liable for underpayments, penalties or claims arising from pay decisions you make, including ones based on information shown in Muster (see section 6); and
- our total liability to you is limited to the amount you paid us in the 12 months before the claim.
11. Changes to these terms
We may update these terms as Muster changes. We'll update the date at the top, and for significant changes we'll email business owners at least 30 days before they apply. If you keep using Muster after that, the new terms apply. If you don't agree, you can cancel before they take effect.
12. General
These terms are governed by the laws of Queensland, Australia, and the courts of Queensland have jurisdiction. If part of these terms is found to be unenforceable, the rest still applies. If you have a problem, please contact us first — most things can be sorted out quickly.
